Via Ascendary is a brand operated by Ascendary Mentorship Solutions FZCO, a company registered in the United Arab Emirates. All Services provided under the Via Ascendary name are offered, operated, and governed by Ascendary Mentorship Solutions FZCO.

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

We reserve the right to modify subscription fees. We will provide you with reasonable notice of any price changes, and such changes will take effect at the start of your next billing cycle after the notice period.

5. Cancellation and Refund Policy

5.1 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will be effective at the end of your current billing period, and you will retain access to the Services until that time.

5.2 No Refunds

All fees paid are non-refundable. We do not provide refunds or credits for partial subscription periods, unused services, or cancelled subscriptions.

6. Intellectual Property Rights

6.1 Our Content

All content provided through our Services, including but not limited to text, graphics, logos, images, audio clips, video clips, data compilations, software, and course materials (collectively, “Our Content”), is owned by or licensed to Ascendary and is protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use Our Content solely for your personal, non-commercial use in connection with the Services.

6.2 User-Generated Content

By posting, uploading, or submitting any content to our Services (“User Content”), you grant Ascendary a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable, and sublicensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content for educational, marketing, and promotional purposes, including on social media platforms and websites.

You acknowledge and agree that:

  • No compensation will be provided for the use of your User Content

  • Your use or inability to use the Services
  • Any unauthorized access to or use of our servers
  • Any interruption or cessation of the Services
  • Any bugs, viruses, or other harmful code transmitted through the Services

  • Any conduct or content of any third party

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Dubai, United Arab Emirates, for the resolution of any disputes.

18. Dispute Resolution

In the event of any dispute arising from or relating to these Terms or the Services, the parties agree to first attempt to resolve the dispute through good faith negotiations. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through the courts as provided in Section 17.

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ascendary regarding the Services and supersede all prior agreements and understandings.

21. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by an authorized representative of Ascendary.

22. Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms without restriction.
